U T of J&K & Ors. . ... Respondent (s) Through:-
CORAM: HON’BLE MR. JUSTICE RAJESH SEKHRI, JUDGE
ORDER
08.11.2025.
1. Short grievance projected by the petitioner in the present petition is that he was holding driving license since 1984, which was valid upto 14.09.1987. The said license came to be renewed by licensing authority, Jammu from time to time upto 2022. On the expiry of renewal on 24.06.2022, he applied for renewal of license before licensing authority, which came to be refused on the ground that original license was issued by licensing authority, Jammu and record was not available in the Srinagar Office. As a consequence, he applied before licensing authority, Jammu for renewal of license. However, when it did not evoke any response, he preferred a writ petition-WP( C ) No. 2709/2022, which came to be
disposed of by this Court vide order dated 15.05.2023, directing respondents to renew driving license of the petitioner in accordance with law. According to the petitioner, when aforesaid order was not complied with, he preferred CCP(S) No. 381/2023, for enforcement of order and subsequently RTO, Kashmir vide his
order No. 3616-19-RTOK dated 30.08.2024, renewed his driving license till 29th August, 2029.
2. Allegation of the petitioner is that despite renewal of his license, respondents did not uploaded his license details on the SARATHI Parivahan Sr. No. 17
2
Portal, official database for driving license in India, as a result of which license of the petitioner is not reflected in the national records. According to the petitioner, due to inaction on the part of licensing authority he is facing hardships to ply his vehicle on public roads and respondents have not done the needful despite various representations and issuance of legal notice by him.
3. Mr. Ruaani Ahmad Baba, learned counsel for the petitioner submits that it shall be suffice, if the present petition is disposed of at its threshold with a direction to the respondents to accord consideration to upload driving license of the petitioner on the Portal, and issue physical license in his favour.
4. Having regard to the limited nature of controversy involved and an innocuous prayer made by learned counsel for the petitioner, the present petition is admitted to hearing and is disposed of at its threshold with a direction to the respondents to consider the claim of the petitioner and upload his renewed driving license details on SARATHI Parivahan Portal, and issue physical smart card license in his favour within a period of four weeks from the date, copy of this order along with petition and annexures are made available to them.
