GP FOR HOME The Court made the following Order: Learned counsel for the petitioner submits that the petitioner is aggrieved by inaction on the part of the respondent No.5 in taking any action on the representation of the petitioner dated 25.02.2025. 2 2. Learned counsel for the petitioner submits that the petitioner has filed O.S.No.105 of 2023 on the file of Civil Judge- cum-(Junior Division)-Judicial Magistrate of First Class Court, Darsi, in which the suit is decreed, granting permanent injunction restraining the defendants therein from interfering with the peaceful possession and enjoyment of the scheduled property. 3. It is further submitted by the learned counsel for the petitioner that the defendants in the suit had filed a similar case against the petitioner vide C.C.No.347 of 2015 on the file of Judicial Magistrate of First Class Court, Darsi, for the alleged offences punishable under Sections 452, 324, 506 read with 34 of IPC and the same was dismissed after trial and the accused therein was acquitted. Admittedly, there are disputes between the petitioner and third parties over the property, which is in possession and enjoyment of the petitioner. 4. In this regard, the petitioner made a representation to the police, to extent the police aid for honoring the injunction granted by the Civil Court. However, the respondents are so far not acted on the complaint. 3 5. Heard the learned Assistant Government Pleader who is appearing for the respondents, the 5th respondent is hereby directed to follow the procedure as contemplated under Section 173(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, keeping in view of the injunction granted in favour of the petitioner and the pending disputes between the petitioner and the third parties, duly taking into consideration the acquittal of the petitioner in C.C.No.347 of 2015 2015 on the file of Judicial Magistrate of First Class Court, Darsi. 6. With these observations, the Writ Petition is disposed of. There shall be no order as to costs.
