Heard learned counsel for the petitioners and perused the record. 2. The present petition has been filed with the following prayer: "To direct the Civil Court (Jr. Division) Deoria to restrain the respondents-defendants not to encroach over the land (Arazi No.101J, Rakba 0-057 Aer means 14 Dismil situated at Kasba Bhatpar Rani Tappa Haveli, Parganan-Salempur Majhauli, Tehsil-Bhatpar Rani, District - Deoria) which is under dispute till finalization of Suit No.526/1998 (Ajay Pratap Shahi and others Vs. Kameshwar Singh and others) and which is also pending before the Civil Court (Jr. Division) Deoria." 3. The grievance of the petitioners can be taken care by the Civil Court where the suit is pending. 4. In view of the above, I am not inclined to entertain the instant petition. 5. Accordingly, the petition is disposed of with liberty to the petitioner to move appropriate application before the trial court for redressal of his grievance, if so advised.
