GP FOR MINES AND GEOLOGY (AP) The Court made the following: ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “.... to issue an order writ or direction more particularly in the nature of Writ of Mandamus declaring the action of the respondents in seizing JCB vehicle bearing No. AP 03BD 8086 of the petitioner on the ground that it is loading the mud clay as arbitrary, illegal, without power or authority and consequently direct the respondents to release the JCB vehicle bearing No. AP 03BD 8086 and pass ….”. 2 2. None appears for the petitioner. Learned Assistant Government Pleader for Mines and Geology is present. 3. As observed from the proceedings sheet, this Court on 06.01.2017 has passed the following interim order: “W.P.No.1362 of 2016 Rule Nisi. Call for records. Notice returnable in four (4) weeks. W.P.M.P.No.1540 of 2016 Subject to petitioner depositing an amount of Rs.1,00,000/- (Rupees one lakh only) with the third respondent, the vehicle bearing registration No.AP 03BD 8086 be released in his favour. However, the petitioner shall not create any third party interest nor change the ownership of the vehicle during the pendency of this writ petition. Petitioner shall produce the vehicle as and when required. After the proceedings are concluded, the amount deposited by the petitioner shall be adjusted towards any liability fixed.” 4. On hearing, learned Assistant Government Pleader appearing for the respondents submits that, in view of the interim order of this Court, dated 06.01.2017, the grievance of the petitioner was redressed. Hence, no further orders are required to be passed in the Writ Petition and it may be closed. 5. Recording the above submission, the Writ Petition is closed.
