Learned counsel appearing on behalf of the petitioner has drawn the attention of this court to the order passed by the learned Special Judge Anti Corruption, Pulwama dated 02.12.2024 in case titled “UT of J&K Th. Vigilance Organization Kashmir vs. Gh. Nabi Gami and Ors.” which has been disposed of in the following manner: The main charge sheet was called from the office which on perusal transpires that the applicant/accused namely Gh. Nabi Gani 5/0 Abdul Ahad Gami R/O SK Colony Qamarwari Srinagar is facing trial for the commission of offence u/s 5 (1) (d) r/w section 5 (2) J&K PC Act. in FIR No: FIR No. 21/2009, of P/S VOK Srinagar On further perusal of 2, the charge sheet it has been found that the case is pending for evidence of the prosecution and 12 number of witnesses have already been examined by this court and the next date of hearing in the charge sheet is 23.1.2025. The Id. Counsel for the applicant has filed medical record of the wife of the applicant along with the said into application and keeping consideration the medical condition of the wife of the applicant as contended by ld Counsel for the applicant in the Court, I deem it proper to modify the earlier order passed by this court vide order dated 29/11/2023 r/w order dated 30/9/2024 and is thus clarified that this court has no objection if the PSK issues passport in favour of the applicant for full term or any particular period according to the rules governing the "subject". 2. Learned counsel appearing on behalf of the petitioner further submits that pursuant to the order passed by the learned Special Judge, Anti-Corruption, Pulwama, the petitioner approached the respondent No. 2 for issuance of the passport in his favour in conformity with the said order/judgment passed by the learned trial court and since the said application was not accorded due consideration, the petitioner was constrained to file the instant petition whereby direction has been sought against the respondents to issue full-term passport in his favour without any further delay, so that the petitioner is in a position to visit abroad along with his wife for getting his spouse’s periodical medical checkups. 3. The record reveals that the notice was issued in the instant matter on 07.05.2025 and till date the respondents have chosen not to file any reply. However, today when the instant petition was taken up, the learned counsel appearing on behalf of the petitioner submits that she would feel satisfied if a direction is issued to the respondent No. 2 to decide the petitioner’s application expeditiously, in conformity with the directions passed by the learned trial court referred to hereinabove, to which Mr. T. M. Shamsi, learned DSGI, is not averse. 4. With the consent of learned counsel for the parties, the instant petition is taken up for final disposal at this stage and is accordingly disposed of by directing the respondent No. 2 to consider and decide the petitioner’s application within a period of two weeks from the date copy of this order, along with the writ petition and Annexures is served to the said respondents strictly in tune with the order/judgment passed by the learned court of Special Judge Anti Corruption, Pulwama, dated 02.12.2024 and in accordance with law. Let the decision be taken within the aforesaid period positively. The writ petition is disposed of in the manner indicated above.
