Heard learned counsel for the petitioner, learned Standing Counsel for the State- respondent and Sri R.S. Chaudhary, learned counsel appearing for the respondent no. 4. 2. The present writ petition has been filed for a direction upon respondent no.2 to decide the appeal being Appeal No. C-2008 of 2025 (Mohan Lal vs. Sub Divisional Magistrate Maharajganj and Anr.) filed by the petitioner under Section 13(1) of U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016. 3. It is contended by learned counsel for the petitioner that even after expiry of sufficient period, petitioner's appeal has not been considered, till date. 4. Learned Standing Counsel states that in case petitioner's appeal has not been considered so far, the same shall be examined by the competent authority in accordance with law. 5. In the aforesaid facts and circumstances, this writ petition stands disposed of with a direction upon the respondent no.2 to accord consideration to petitioner's pending appeal, by passing appropriate order, in accordance with law, after affording opportunity of hearing to the parties concerned, within a period of two months from the date of presentation of certified copy of this order. 6. It is, however, clarified that this Court has not expressed any opinion on merits of the case and all issues are left open to be considered by the authority competent, at the first instance.
