HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL REVISION No. - 6371 of 2025 Court No. - 91 HON'BLE ABDUL SHAHID, J.
1. Heard learned counsel for the revisionist and learned AGA for the State.
2. The instant revision has been filed against the order dated 15.9.2025 passed by Additional Sessions Judge, Court No.6, Aligarh in S.T. No.889 of 2012 arising out of Case Crime No.122 of 2012 (State of UP vs. Yogendra Sharma and others) under Section 302 IPC, P.S.-Gandhi Park, District-Aligarh.
3. Learned counsel for the revisionist has submitted that he had filed an application dated 15.9.2025 under Section 311 Cr.P.C. He wants to further cross-examine PW-1 (Buddhsen) and PW-2 (Danveer). The examination in chief as well as cross-examination of both the witnesses had been completed on 15.1.2014 and 14.2.2014 respectively. The revisionist wants further opportunity to cross-examination of both the witnesses and submitted that there are contradictions in their statements.
4. On the contrary, learned AGA appearing for the State has submitted that both the witnesses had already been completely cross-examined and the appreciation of the evidence would be done by the trial court at the appropriate stage.
5. Perused the impugned order dated 15.9.2025 and the material on record. Versus Counsel for Revisionist(s) : Nanhe Lal Tripathi, Rahul Upadhyay Counsel for Opposite Party(s) : G.A. Yogendra Sharma .....Revisionist(s) State of U.P. .....Opposite Party(s)
6. It appears that the matter in dispute before the trial court is of the year 2012 under Section 302 IPC. The examination in chief and cross- examination are already completed of PW-1 and PW-2 on 15.1.2014 and 14.2.2014 respectively. This application has been filed on 15.9.2025 after a gap of more than 11 years to further cross-examine both the witnesses. It is also mentioned by the learned trial court in impugned order that the defence counsel had not point out as to what point have been left for which he wants to recall the above witnesses. If the defence is given such opportunity, the process will go on.
7. In view thereof, there is no illegality or irregularity or jurisdictional error in the impugned order dated 15.9.2025. Hence the instant revision is liable to be dismissed.
8. It is, accordingly, dismissed. October 13, 2025 LN Tripathi CRLR No. 6371 of 2025 2 (Abdul Shahid,J.) Digitally signed by :- LALIT TRIPATHI High Court of Judicature at Allahabad
