GP FOR REVENUE (AP) 2 The Court made the following: ORDER: The present writ petition is filed questioning the action of the 4th respondent in trying to dispossess the petitioner from the land admeasuring an extend of Ac.1.00 cents in Sy.No.317/8,9 and an extent of Ac.1.00 cents in Sy.No.307/6 of Kantepalli Village, Venkatachala Mandal, SPSR Nellore District. 2. It is the case of the petitioner that he was granted lease patta for the subject lands by the then Mandal Revenue Officer Venkatachalam Mandal, SPSR Nellore District, vide proceedings R.C.No.633/91 dated 19.06.1991 for fasilees from 1400 to 1402, for a period of three (3) years. It is further the case of the petitioner that by virtue of the lease granted, he is in continuous possession of the subject lands. He also stated that he is regularly paying cist raised by the revenue authorities and along with the writ petition he filed the cist receipts dated 22.09.2019 and 06.08.1991. While so, the 4th respondent tried to dispossess the petitioner from the subject lands, without issuing notice and without following procedure contemplated under law. He further contended that he is in possession of the subject lands and as on the date of filing of the writ petition, there was standing paddy crop. Since the 4th respondent tried to interfere with the possession of the petitioner, the present writ petition filed. 3 3. Heard learned counsel for the petitioner and learned Government Pleader for Revenue. 4. This Court while ordering notice on 17.03.2020, directed the parties to maintain status quo with regard to the possession of the subject property. The said order is subsisting till today. Though the lease patta dated 19.06.1991 was granted in favour of the petitioner for a period of three years, he claims that, he continued to be in possession of the subject lands, pursuant to the interim order granted by this Court. In view of the above, the present writ petition is disposed of directing the respondents not to interfere with the possession of the petitioner over the lands in dispute without following due process of law. 5. With the above observations, the writ petition is disposed of. No costs.
