By means of the present criminal writ petition, petitioners have challenged the FIR No.340 of 2021 dated 15.10.2021 registered with P.S. Sitarganj, District Udham Singh Nagar under Section 408 IPC. 5. It is contended by the learned State Counsel that after investigation, charge-sheet has already been filed by the police on 29.04.2022 against the petitioners, therefore, nothing remains to be decided in this writ petition and it becomes infructuous. 6. The said fact is not disputed by learned counsel appearing for the petitioners. 7. In view of the statement made by learned State Counsel, the present criminal writ petition is dismissed as infructuous. However, a liberty is given to petitioners to challenge the charge-sheet in appropriate proceedings, before the appropriate forum. 8. Interim order dated 22.10.2021 stands vacated. 9.
