Learned counsel for the applicant submits that applicant is although named in the FIR along with his two other family members but as per allegation, made in the FIR, co-accused Bhaiyava Nishad was the principal accused. He further submits that when the statements of eye-witnesses Priyanka Devi and Akhilesh were recorded then they stated that applicant and other co-accused made assault due to which deceased sustained injuries and died and therefore, during investigation, it reflects, prosecution developed a new story. 4. He further submits that even from the statements of eye- witnesses, it could not be reflected that applicant and others were having any intention to cause the death of the deceased. It is further submitted that on the similar footing the co-accused Nanbaccha has been granted bail by the Court vide order dated 21.05.2025 passed in Criminal Misc. Bail Application No. 39313 of 2024, therefore, the applicant is also entitled to be released on bail. Per contra, learned AGA however opposed the prayer for bail but could not dispute the arguments on facts advanced by learned counsel for the applicant. 6. I have heard both the parties and perused the record of the case. 7. Further, even from the statements of eye-witnesses, it reflects, they did not assign any specific weapon to any accused and according to them, applicant and others including co-accused Bhaiyava Nishad were making assault through wooden stick, kicks and fists but they further stated that co-accused Bhaiyava Nishad after the incident threw the wooden stick in the river, therefore, even from their statements, it reflects, co-accused Bhaiyava Nishad was the principal accused, who was having wooden stick. 8. Further, the applicant is having no criminal history and he is in jail in the present matter since 23.07.2024. 9. Therefore, considering the facts and circumstances of the case discussed above, in my view applicant is entitled to be released on bail. 10.
