The prosecution story in brief is that the accused applicant obtained the facility of gunner by falsely claiming holding reputed post in the year 2020. Informant alleged on 18.10.2020 that accused applicant sent the e-mails to Senior Superintendent of Police Ghaziabad and District Magistrate, Ghaziabad for providing a gunner and claimed himself as member of Scheduled Caste front of Bhartiya Janta Party and Former Advisory Member of Central Board of Film Certification. Subsequently informant mentioned the dates on which accused applicant availed the facility of gunner by claiming himself as Additional member of Northern Railway Ministry
5. Learned counsel for the applicant submits that the applicant has been nominated as a member of Zonal Railway Users Consultative Committee and accordingly got the facilities and the amenities which subsequently were terminated after having been arrested in case crime No. 0383 of 2023. and it is not out of place to mention here that
the accused applicant is not only the member of Northern Railway Ministry of Railway, Government of India, but also the member of Food Corporation of India, Ministry for Consumer Affairs, Food and Public Distribution. The investigating Officer filed the charge sheet under sections 419, 468, 471 IPC before the court below. Nothing incriminating has been recovered from the possession of the applicant but due to enmity with the police, he has been falsely implicated in the present case. The criminal history of the applicant has already been mentioned in the affidavit of the applicant. He next submits that applicant is languishing in jail since 05.07.2024. It is thus contended that the applicant is entitled for bail. 6.
On the other hand, learned A.G.A. for the State has contended that there is specific allegation against the applicant. The applicant on the basis of forged e-mail obtained police protection deliberately from time to time. The applicant has also shown himself as member of Bhartiya Janta Party. 7. Perusal of the record shows that the applicant has obtained the police security on the basis of forged and fabricated e-mail sent to the Superintendent of Police and District Magistrate, Ghaziabad. which version is fully supported by the case diary. Accused applicant has accepted the fact that he has obtained the police protection but also accepted the fact that he has not paid any amount to the Government for the police protection. 8. Keeping in view submissions of learned counsel for the parties, gravity of offence, nature of allegations and all the attending facts and circumstances of the case, without expressing any opinion on the merits of the case, I do not find any good reason to exercise my discretion in favour of the accused-applicant. 9. However, learned trial court is directed to expedite the trial without granting any adjournment to either of the side. 10. Accordingly, the bail application stands rejected.
