P LAXMA REDDY The Court made the following Order: The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: “…..to issue a writ or order or direction especially one in the nature of Writ of Mandamus (i) declare the Memo No.DEE/O/KLDG/Adm/JAO/C3/D.No.703/2012 dated 22-09- 2012 issued by the 3rd respondent as illegal, arbitrary and 2 set aside the same (ii) consequently direct the respondents to retain the petitioner at Operation Section, Rayadurg, Anantapur District….” 2. This Court, vide order, dated 17.10.2012 has granted interim suspension of the impugned memo No.DEE/O/KLDG/Adm/JAO/C3/ D.No.703/2012, dated 22.09.2012 issued by the 3rd respondent. 3. Today, when the matter is taken up for hearing, none appeared for the petitioner. 4. Heard Mr.Venkata Rama Rao Kota, learned Standing Counsel for APSPDCL, for the 3rd respondent. 5. On hearing, learned Standing Counsel furnished a copy of instructions issued by Executive Engineer, Operation Division, Kalyandurg and submits that the petitioner was covered in the General Transfers 2015-16. In view of the transfer guidelines, the petitioner along with others who were covered in the general transfers were transferred. Accordingly, the petitioner was also transferred to D.Hirehal Section in Rayadurg Sub-Division vide Memo No.DEE/O/KLDG/Adm/JAO/C1/D.No.262/2015, dated 31.05.2015. Further, the petitioner without any grievance accepted the transferred orders and joined at D.Hirehal Section of Rayadurg Sub-Division. The transfer orders were issued to all the employees and not individually to the petitioner. He further submits that the petitioner was retired from service on 31.10.2019 Afternoon after attaining the age of Superannuation. Therefore, learned Standing Counsel submits that by recording the same, the writ petition may be closed. 3 6. On considering the submissions of learned Standing Counsel and upon perusing the entire material on record, this Court is of the opinion that, nothing survives in the present writ petition for any adjudication and the same is liable to be closed. 7. Accordingly, the Writ Petition is closed. No costs. 8. As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand dismissed. ________________________ DR. K.
