The petitioners seek bail in connection with Giriak (Katrisarai) P.S. Case No. 379 of 2024 instituted for the offence under Sections 342(1), 316(2), 318(4), 319(2), 336(3), 338, 339,
Patna High Court CR. MISC. No.2685 of 2025(3) dt.15-04-2025 2/4 340(2), 341(1), 3(5), 61(2), 111(2)(b) of the Bharatiya Nyaya Sanhita, 2023 and Sections 66(c) & 66(D) of the I.T. Act and Sections 25(1-B)a, 26 & 35 of the Arms Act. 3. Prosecution case in brief is that on October 2, 2024, police received information about a cyber fraud gang operating from Ahiyachak market. A raid was conducted in village Rasalpur, leading to the arrest of four accused persons and recovery of numerous debit cards, mobile phones, cash, and a country-made pistol. Further interrogation revealed names of additional gang members, where the names of petitioners surfaced. Subsequent raids led to recovery of more cyber-related items and arrest of other accused. The gang is accused of collectively committing cyber fraud by luring innocent people. 4. It has been submitted on behalf of the petitioners that the petitioners are in custody since 03-10-2024. Petitioners bear no criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application. 5.
It has been further submitted by the petitioners’ counsel that petitioners have been falsely implicated in the present case. The petitioner’s counsel contends that petitioners are completely innocent and have no involvement in the alleged cyber fraud or any connection with the seized articles,
Patna High Court CR. MISC. No.2685 of 2025(3) dt.15-04-2025 3/4 particularly no arms being recovered from them. It is submitted that that names of the petitioners are falsely implicated due to a family dispute, as the main accused – their own cousin – named the petitioners in their statements out of jealousy. Learned counsel goes on to submit that there are no independent witnesses to the seizure, no compliance with Section 185 of BNSS 2023, and no mandatory video recording of the search and seizure process. Leared counsel for the petitioner lastly submits that the charge-sheet has already been submitted without sufficient evidence against him. 6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. It is fervently submitted that petitioners have confessed their guilt in their confessional statement, which fact finds mention at paragraph No. 14 of the case diary. It is next contended that there is recovery of 11 cyber related articles items from Sanjay Kumar @ Sanjay Ravidas, 26 items from Mantu Ravidas @ Mantu Kumar and 21 items from the Dharmendra Ravidas @ Dharo @ D.J @ Dharmendra Kumar. 7. Considering the aforesaid facts and circumstances of the case, it appears that petitioners are involved in serious offence of cyber fraud, which resulted in substantial monetary

Hence, taking into account the nature and gravity of the offence coupled with the fact that this type of offences are not confined to individual harm but pose a serious threat to the public order and the moral fabric of society at large, this Court, at this stage, is not inclined to grant bail to the petitioners. Prayer for bail is accordingly rejected. 8. The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and unnecessary adjournments. 9. However, petitioners are at liberty to renew their prayer for bail if the trial is not concluded within a period of six months from today. Raj Kishore/- (Rudra Prakash Mishra, J) U T
