[2025:RJ-JP:11056] (2 of 2) [CRLMB-3407/2025]
3.
Learned counsel for the complainant concedes that the petitioner and the prosecutrix have entered into marriage and the prosecutrix has also executed an affidavit indicating the fact that she has entered into marriage with the petitioner, therefore, if the bail application of the accused-petitioner is allowed then the prosecutrix has not objection.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. Heard and perused the material available on record.
6. It is not desirable to express anything on the merits of the case as the prosecutrix herself has executed an affidavit in favour of the petitioner that she has solemnized marriage on 14.02.2025, without going into merits, I deem it just and proper to enlarge the accused-petitioner on bail.
7. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Rajpal Singh Rathore @ Rudra S/o Laxman Singh, in connection with FIR No.91/2025 registered at Police Station Shipra Path, District Jaipur City (South) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
