Borthakur, learned Additional Public Prosecutor appearing for the State respondent. This interlocutory application is filed under Section 430(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023 for suspension of the sentence and for allowing the applicants to remain on previous bail during pendency of the criminal revision petition. Mr. S. Das, learned counsel appearing for the applicants submits that during the period of trial, the applicants were on bail and had appeared on all dates as fixed by the trial court. Accordingly he seeks direction for allowing the applicants to remain on previous bail during pendency of the criminal revision petition. Mr. P. Borthakur, learned Additional Public Prosecutor appearing for the State respondent fairly submits that since he had been in bail during the trial and has not done anything to hamper the trial, the prayer may be considered. Accordingly, the applicants i.e. Kandarpa Keot and Hitesh Khatoniar are allowed to remain on their previous bail during the pendency of the connected criminal revision petition.
