Court No. - 87 Case :- APPLICATION U/S 482 No. - 34553 of 2024 Applicant :- Smt. Manju Lala Opposite Party :- State Of U.P. And 2 Others Counsel for Applicant :- Pradip Kumar Srivastava Counsel for Opposite Party :- G.A. Hon'ble Prashant Kumar,J.
1. Heard Sri Pradip Kumar Srivastava, learned counsel for the applicant, Sri Jyoti Singh, learned Additional Government Advocate for the State-O.P. no.1 and perused the record.
2. The present application has been filed by the applicant praying for quashing the order dated 11-10-2023 as well as order dated 19- 06-2024 in Revision No. 378 of 2023 passed by learned Additional District and Sessions Judge, Court No.12, Kanpur Nagar.
3. Learned counsel for the applicant submits that on 13.03.2022, the applicant, Smt. Manju Lala, alleges that while she was alone at her residence, opposite party no. 2 and 3 entered her room, assaulted her, and attempted to violate her modesty. When she protested, they threatened her with dire consequences. Despite approaching the concerned police station in Kakadeo, Kanpur Nagar, no action was taken. The applicant then filed an application under Section 156(3) Cr.P.C. before the Court of Metropolitan Magistrate II, Kanpur Nagar, seeking direction to the police to register an FIR, but her complaint was rejected by order dated
11.10.2023. Subsequently, she filed a criminal revision before the Court of District & Sessions Judge, Kanpur Nagar, which was also dismissed on 19.06.2024. The applicant contends that both courts failed to properly consider the evidence and circumstances surrounding her complaint, and the rejection of her application and revision was unjust.
4. Per contra, learned A.G.A. has vehemently opposed the application and contended that the lower courts have rightly rejected the complaints based on the absence of sufficient evidence to support the allegations. The rejection of the application and revision is in accordance with the law.
5. Upon hearing the learned counsel for the parties and after
perusal of the material on record, this Court finds no illegality, irregularity, or perversity in the impugned orders passed by the courts below so as to warrant interference under Section 482 Cr.P.C.
6. Hence, the instant application cannot be entertained and is, accordingly, dismissed. Order Date :- 22.4.2025 pks Digitally signed by :- PANKAJ KUMAR SRIVASTAVA High Court of Judicature at Allahabad Digitally signed by :- PANKAJ KUMAR SRIVASTAVA High Court of Judicature at Allahabad
