This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with Dumri P.S. Case No.76 of 2024, for offences under Sections 379, 411, 414 and 34 IPC. The case is presently pending before the Court of learned Additional Chief Judicial Magistrate, Giridih.

It is alleged that a truck was stolen by the miscreants. From the CCTV footage, the car which was used in stealing the truck was identified and thereafter the co-accused were arrested. They disclosed in detail that how they had committed the offence. One of the co-accused namely Baban Kumar has stated that it was this petitioner and others who had helped him in stealing the truck. The case is still under investigation.

Learned counsel representing the petitioner submits that only on the basis of confessional statement of co-accused, the petitioner has been made accused and except that there is nothing against this petitioner.

Learned A.P.P. representing the State opposes the prayer for anticipatory bail.

Considering the aforesaid fact, I am of the opinion that this case needs investigation including custodial investigation of this petitioner. Thus, I am not inclined to grant anticipatory bail to this petitioner.

Accordingly, this Anticipatory Bail Application stands dismissed.
