Grievance of the petitioner is that a culvert (minor bridge) is being constructed on the Bhoomdhari land of the petitioner without any acquisition of his land or consent on his part. Taking cognizance of the grievance, we invited instructions from respondents. Learned State Counsel has obtained instructions which are taken on record. Its copy is given to the learned counsel for the petitioner. As per instructions, none of the land of the petitioner has been utilized for construction of the culvert (minor bridge). It is also stated that construction has been made on the land recorded as drain in the revenue record. From the materials placed on record, it appears that there are issues of demarcation and identity of the land over which constructions are raised. Such issues of fact can always been got determined by the revenue authorities. Although it is stated that the revenue authorities have inspected the site and measured the land but since the proceedings were not undertaken in the presence of the petitioner, we dispose of the writ petition with direction upon 4th respondent to constitute a revenue team and get the petitioner's plot measured on the spot. If it is found that any of the land of the petitioner has been utilized for the State's scheme, the authorities will take appropriate decision to compensate the petitioner. Such action will be taken within a period of three months from the date of presentation of copy of this order before him.
