The present bail application has been moved by the applicant-accused Kasim for the offence punishable under Section 307 IPC and Section 3/25 Arms Act, in Case Crime No. 90 of 2024, Police Station- Kapoorpur, District Hapur. 2. Mr. Anurag Shukla, learned advocate, appears on behalf of applicant and submits that accused-applicant has been falsely implicated in the police encounter case. He further submits that this is a no injury case. The arrest and recovery has been made in absence of independent witness. The charge sheet has been submitted in the matter. There is criminal history of 14 cases to the credit to the credit of the accused-applicant, which has been duly explained and in all the cases, he is on bail, whereas the one case is lodged against the accused on the same day. The accused- applicant is in jail since June, 2024. 3. Per contra, learned AGA has opposed the prayer for bail and submits that the charge sheet has been submitted against the accused-applicant. Though concedes that other co-accused have been granted bail by the coordinate Bench of this Court. 4. Taken into consideration the rival submissions made by the parties and perused the record. 5. The perusal of the record reveals that the accused is named in the FIR. This is a no injury case. The charge sheet has been submitted in the matter. There is criminal history of 14 cases to the credit of the accused-applicant, which is duly explained and in all the cases he is on bail. Without touching the merit of the case, this bail application is allowed. 6. Let the accused applicant be enlarged on bail subject to furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned.
