Petitioners were appointed as daily wagers in Public Works Department, Construction Division, Haldwani in the year 1984-1985, thereafter their status was upgraded as work- charged employees in the year 1999 and they were subsequently regularised in 2013. All the petitioners have now retired from services. 3. By means of this writ petition, petitioners have sought a direction to the respondent to count the service rendered by them in work- charged establishment for the purposes of pensionary benefits. 4. Petitioners have relied upon a judgment rendered by Hon’ble Supreme Court in the case of Prem Singh Vs. State of U.P. and others reported in AIR 2019 SC 4390. 5. Learned counsel for the petitioners submits that petitioners made representation from time to time to the competent authority, but no decision has been taken thereupon. He submits that petitioners be permitted to make 2025:UHC:7387 fresh representation to the Engineer-in-Chief, Public Works Department, who may be directed to take decision thereupon. 6. Having regard to the facts of the case, writ petition is disposed of by permitting petitioners to make representation to the Engineer-in-Chief, Public Works Department. If petitioners make such representation within three weeks from today, decision thereupon shall be taken within six months thereafter.
