Heard learned counsel for the applicants and learned AGA for the State. 2. This application has been filed by applicants for quashing the entire proceeding of Case No.4570 of 2024 (Anita Singh Vs. Diksha Singh and others) under Section 12 of the Protection of Women from Domestic Violence Act, 2005, pending before ACJ (S.D.), Court No.5, Kanpur Nagar with its all-consequential effects whatsoever throughout. 3. It is submitted by learned counsel for applicants that proceedings under the Domestic Violence Act are under challenge. 4. On a query being made to learned counsel for applicants as to any order has been passed under Section 12 of Domestic Violence Act, learned counsel for applicants fairly submits that till date no order has been passed. 5. Mere filing of application under Section 12 of Domestic Violence Act and mere issuing of notice would not amount the cause of action. It is always open for the applicants to file their objection before the court concerned in the proceedings under Section 12 of Domestic Violence Act. At this stage, this Court does not deem it fit to interfere in the proceedings. 6. Accordingly, the application under Section 528 BNSS is dismissed. October 10, 2025 D.
