Hon'ble J.J. Munir,J. An affidavit has been filed by the Consolidation Commissioner, U.P. in compliance with the order dated 08.01.2025. It is averred in paragraph nos. 7, 8 and 9: "7. That further, the Consolidation Commissioner, U.P., Lucknow vide letter dated 23-12-2023 issued directions to all the District Magistrates/District Deputy Director of Consolidation of State whereby Standard Operation Procedure have been prescribed for including a village under the consolidation operation. Copy of letter dated 23-12-2023 of the Consolidation Commissioner, U.P., Lucknow is being annexed herewith and is marked as Annexure No.3 to this affidavit. 8. That the deponent most respectfully submits that again vide letter dated 02-01- 2025 issued by the Consolidation Commissioner, U.P., Lucknow, directions were issued to all the District Magistrates/District Deputy Director of Consolidation of State regarding Standard Operation Procedure fixed for brining a village under the consolidation operation. Copy of letter dated 02-01-2025 of the Consolidation Commissioner, U.P., Lucknow is being annexed herewith and is marked as Annexure No.4 to this affidavit. 9. That the deponent further most respectfully submits that in compliance with order dated 08-01-2025 passed by this Hon'ble Court in the instant writ petition, the deponent had issued letter dated 13-01-2025 to the District Magistrate/District Deputy Director of Consolidation, Basti to send amended proposal in Format No.2 and in accordance with the directions and Standard Operation Procedure as prescribed in letters dated 12-12-2024, 23-12-2024 and 02-01-2025 for binging the Village-Jagannathpur, Gram Panchayat-Hyderabad, Tappa Belwa, Pargana Amodha, Tehsil Harraiya, District-Basti under the consolidation operation under Section 4(2) of the U.P. Consolidation of Holdings Act, 1953. Copy of letter dated 13-01-2025 of the deponent is being annexed herewith and is marked as Annexure No.5 to this affidavit." When the matter has come up today, learned Standing Counsel has produced before the Court written instructions received from the Consolidation Commissioner, U.P. dated 13.02.2025, that is to say, of a date much after the affidavit filed by the Consolidation Commissioner. In the written instructions received on behalf of the Consolidation Commissioner, U.P., it is stated: "जजिललाजधिकलाररी / जजिलला उप ससंचलालक चकबन्दरी , बस्तरी कके पत्र ससंख्यला -06/परी० कके ० / धिलारला -4(2)/2024-25 ददनलासंक 02.01.2025 दलारला गलाम जिगरनलाथपपुर तहसरील हररैयला जिनपद बस्तरी कक उ०प्र० जिकत चकबन्दरी अजधिदनयम ककी धिलारला-4 (2) कके अन्तगरत प्रथम चक ककी चकबन्दरी प्रदक्रियला मम प्रख्यलादपत करनके कला अनपुरकधि दकयला गयला हरै दकन्तपु उक्त प्रस्तलाव दनदकेशलालय दलारला दनगरत दनदरश व मलानककों कके अनपुरूप न हकनके कके कलारण दनदकेशलालय कके पत्र ससं 0-257/जिरी0-610/2021-22(3) ददनलासंक 13.01.2025 दलारला पपुननः जजिललाजधिकलाररी/जजिलला उप ससंचलालक चकबन्दरी, बस्तरी सके दनदकेशलालय स्तर सके दनगरत दनदरशकों कके अनपुरूप ससंशकजधित प्रस्तलाव उपलब्धि करलानके कला अनपुरकधि दकयला गयला तथला इसरी आधिलार पर चकबन्दरी आयपुक्त उ०प्र० कला व्यदक्तगत शपथ पत्र पपूवर दनयत दतजथ 31.01.2025 कक दलाजखिल दकयला जिला चपुकला हरै। उपरकक्त क्रिम मम जजिललाजधिकलाररी / जजिलला उप ससंचलालक चकबन्दरी, बस्तरी कके पत्र ससंख्यला -43/परी० कके ०/ धिलारला-4(2)/2024-25 ददनलासंक 23.01.2025 दलारला गलाम जिगरनलाथपपुर तहसरील हररैयला जिनपद बस्तरी कक उ०प्र० जिकत चकबन्दरी अजधिदनयम ककी धिलारला-4 (2) कके अन्तगरत प्रख्यलादपत करनके सम्बन्धिरी ससंशकजधित प्रस्तलाव उपलब्धि करलायला गयला हरै जिक पररीक्षणकोंपरलान्त मलानककों कके अनपुरूप पलायला गयला हरै। (अनपुलग्नक ससंख्यला-1) जजिललाजधिकलाररी/जजिलला उप ससंचलालक चकबन्दरी, बस्तरी कके प्रस्तलाव ददनलासंक 23.01.2025 कके आधिलार पर दनदकेशलालय कके पत्र ससंख्यला - / जिरी0-610/2021-22 (3) ददनलासंक .02.2025 दलारला शलासन सके गलाम जिगरनलाथपपुर कक उ०प्र० जिकत चकबन्दरी अजधिदनयम ककी धिलारला -4(2) कके अन्तगरत प्रख्यलादपत कर चकबन्दरी प्रदक्रियला मम समम्मजलत करनके कला अनपुरकधि दकयला गयला हरै। (अनपुलग्नक ससंख्यला-2) यह अवगत करलानला हरै दक शलासन ककी अनपुमदत कके पश्चलात गलाम जिगरनलाथपपुर कक चकबन्दरी दक्रियलाओसं कके अन्तगरत समम्मजलत दकयला जिलायकेगला।" This petition is disposed of with a direction to the State Government to take necessary steps in the matter expeditiously. Let this order be communicated to the Additional Chief Secretary, Revenue, Government of U.P., Lucknow and the Consolidation Commissioner, U.P., Lucknow through the Civil Judge (Senior Division), Lucknow by the Registrar (Compliance) within 24 hours.
