The present writ petition (criminal) under Article 226 of the Constitution of India is moved on behalf of the Petitioner, Noor Hasan S/o Mehaboob against the Respondents, Satbir Singh S/o Shri Ram Chander is, as per the F.I.R., said to be the name of victim/complainant and Anup Singh S/o Rangi Ram, who had been duped of the money in regard to some land deed; the present writ petition comes with the prayer to quash the impugned F.I.R. dated 09.06.2024 registered as FIR/Case Crime No.0375 of 2024 under Sections 120-B, 420, 467, 468, 471 & 506 of IPC, Police Station – Kotwali Roorkee, District Haridwar. 5. In compliance of the order dated 20.08.2025, whereby the petitioner was directed to implead necessary party, an Impleadment Application (IA No.02 of 2025) is moved on behalf of the petitioner to implead the name of Anup Singh S/o Rangi Ram as respondent no.4. 6. For the reasons stated, the Impleadment Application is allowed. 7. Let amended memo of parties be filed within today itself. 2025:UHC:7734 8. Since the impleadment application is allowed and in the present matter, along with the petitioner, Anup Singh S/o Rangi Ram has been impleaded as party respondent no.4. Heard on the Compounding Application (IA No.01 of 2025) 9. Compounding Application (IA No.01 of 2025) is also annexed with the signatures of the parties with the present application that is supported with the affidavit of the parties and the said application is being endorsed by the learned counsel for the petitioner and Respondent no.3/complainant & 4, Ms. Sadaf Gaur, Advocate and Mr. Faizan Ali, Advocate respectively. 10. The Petitioner, Noor Hasan S/o Mehaboob, Respondent no.3/complainant, Satbir Singh S/o Shri Ram Chander and Anup Singh S/o Rangi Ram are present before this Court, who are identified by their respective counsel. 11. After interacting with the parties especially with Respondent nos. 3 & 4, they make a statement that the dispute has been settled amicably between the parties, now there is no dispute between them and they do not want to proceed with the aforesaid impugned F.I.R. against the petitioner, therefore, the proceedings and other consequential order, if any, arising out of the F.I.R. in question may be quashed. 12. The said compounding application is strongly opposed by the learned State counsel on the ground that some of the offences are non-compoundable. 13. In view of the principle of law laid down by Hon'ble the Apex Court in the case of “Gian Singh vs. State of Punjab” reported in 2012 (10) SCC 303 as well as in Transfer Petition (Criminal) No. 115 of 2012 (Dimpey Gujral vs. Union Territory of Chandigarh) decided on 06.12.2012, criminal 2025:UHC:7734 proceedings can be quashed by this Court, if this Court is satisfied with the facts and circumstances of the case. 14. Keeping in view of the totality of the facts and circumstances of the case, this Court is of the view that ends of justice would be met, if the entire proceedings against the Applicant are hereby quashed. 15. In view of the above, the compounding application is allowed. The impugned F.I.R. dated 09.06.2024 registered as FIR/Case Crime No.0375 of 2024 under Sections 120-B, 420, 467, 468, 471 & 506 of IPC, Police Station – Kotwali Roorkee, District Haridwar, is hereby quashed against qua the petitioner. 16. The present writ petition (criminal) under Article 226 of the Constitution of India is, thus, disposed of in terms of the compromise arrived at between the parties.
