Learned counsel for the petitioners submits that the petitioners are aggrieved by the order passed by the Special Magistrate, Kavali in Crl.M.P.No.2196 of 2022 whereby the learned Magistrate dismissed the 2 application filed by the petitioner on 18.10.2022 seeking to recall PW1 for further cross examination. The present petition is filed after lapse of more than two and half years and this Court finds no grounds to interfere. The reason assigned by the petitioner that the petitioner suffered with some heart related issue on 18.10.2022 could not have precluded the petitioner from submitting the same before the learned Magistrate and filing a fresh application. 3. Hence, this Court finds no grounds to interfere in the belated attempt of the petitioner in trying to challenge an order passed on 18.10.2022. 4. Accordingly, the Criminal Petition is dismissed.
