The instant application has been filed by applicant to quash the entire proceeding of Criminal Case No. 39885 of 2023, Case Crime No. 449 of 2022, under Sections 498-A, 323, 504, 506 IPC and 3/4 D.P. Act, P.S.- Gorakhnath, District- Gorakhpur and charge sheet dated 16.04.2023 and cognizance/summoning order dated 02.08.2023. 3. Learned counsel for the applicant seeks permission to withdraw this case to avail remedy of expeditious and proper disposal of pending cases as enshrined under Section 529 BNSS. 4. In view of above submission, the present application is dismissed as withdrawn with aforesaid liberty. 5. Office is directed to return the certified copy of the order sheet and F.I.R. to learned counsel for the applicant after retaining the photo copy of the same.
