Order on Board 05/03/2025
1.
Learned counsel appearing for the petitioner submits that the matter relates to grant of promotion to the petitioner on the post of Auditor and other consequential benefits from the year 2011. In the year 2011, a DPC was conducted, but, the petitioner, who was entitled for grant of promotion, was Digitally signed by GOPAL SINGH Date: 2025.03.17 18:34:28 +0530
2 not considered and respondent No.4 was promoted. Now, respondent No.4 has also retired and the petitioner is going to be retired on 31.8.2025, as such the limited relief sought by the petitioner is that the petitioner is entitled for the promotion in all respects from the year 2011 itself and a DPC was also conducted, but, the petitioner has not been considered for the promotion without there being any allegation against her. Hence, it is prayed that the respondents authorities may be directed to consider her representation for grant of promotion as she is going to be retired on 31.8.2025.
2. Facing with the situation, learned counsel appearing for the State was queried and it was submitted by him that the representation of the petitioner would be decided in accordance with law. However, it was again queried that since the petitioner is going to be retired on 31.8.2025 when will her representation be decided? Learned counsel for the State submitted that they will make every endeavour to decide the representation of the petitioner within two months so that at the time of her retirement she may not be deprived from her retiral dues in accordance with law.
3. Accordingly, the respondents authorities are directed to decide the representation of the petitioner in respect of her promotion to the post of Auditor in accordance with law within a period of two months from the date of production of a copy of this order. It is made clear that no observation is made on merits of the case.
4. With the aforesaid observations and directions, the writ petition is disposed of. Sd/-
