Heard Sri Badri Kant Shukla, learned counsel for the petitioner and learned Standing Counsel for the State respondents. The present petition has been filed by the petitioner challenging the order dated 5.8.2025 passed by the District Supply Officer, Prayagraj cancelling his fair price shop licence. The learned Standing Counsel has raised a preliminary objection that the petitioner has an alternative remedy of filing appeal under Order 13(1) of the Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016, which has not been availed. In view of the aforesaid facts, the present writ petition is disposed of with liberty to the petitioner to avail alternative remedy of appeal before the Divisional Commissioner against the impugned order dated 5.8.2025.
