Petitioner was serving as Professor in Kumaon University and he was about to complete age of superannuation i.e. 65 years in the month of January, 2021. Before his superannuation, the Executive Council of Kumaon University, in its meeting held on 27.11.2020 took a decision that benefit of re- employment till end of academic session would be available only to such employees of the University who would retire at the age of 62 years. 3. The said decision taken by the Executive Council was communicated to the petitioner by Deputy Registrar of the University vide letter dated 03.12.2020. Feeling aggrieved by the decision taken by Executive Council, as communicated by Deputy Registrar, petitioner filed this writ petition. 4. A coordinate Bench passed interim order on 17.12.2020, directing the University to continue petitioner’s service till end of academic session i.e. 30.06.2021. 2025:UHC:6425-DB 5. Mr. Krishna Kant Joshi, learned counsel holding brief of Mr. Dharmendra Barthwal, learned counsel appearing for petitioner submits that writ petition has now become infructuous as petitioner served on re- employment till 30.06.2021, pursuant to interim order passed by this Court and thereafter the relief as claimed do not survive. 6.
