3. The learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. The recovery of a torn diary has been planted upon him. The mobile phone recovered from the petitioner was sent for cyber analysis and has revealed that the petitioner was in contact with some Pakistani numbers. There is no evidence that he was supplying/providing any information to the Pakistani authorities. As he is in custody since 22.09.2023, the report under Section 173(2) Cr.PC stands presented but none of the 13 Pws have bee examined so far, the Trial of the present case is not likely to be concluded anytime soon. Therefore, he is entitled to the concession of bail. 4. The Counsel for the State has filed additional affidavit of Mr. Deepak Pareek, IPS Senior Superintendent of Police, Tarn Taran, District Tarn Taran in the Court today, which is taken on record. While referring to the same, he contends that the mobile phone of the petitioner was sent to
analysis and upon the same it transpires that the petitioner was in touch with some individuals based in Pakistan and there were certain photographs taken from his phone. Therefore, he is not entitled to the concession of bail. He however fairly concedes that the petitioner is a first time offender, in custody since 22.09.2023 and that one of the 13 Pws have been examined so far.
5. I have heard the learned counsel for the parties.
6. The veracity of the prosecution case against the petitioner shall be adjudicated upon during the course of the trial. Admittedly, he is stated to be in custody since 22.09.2023 and none of the 13 prosecution witnesses have been examined so far. Therefore, his further incarceration is not required.
