No.618 of 2025. 2. The allegations in this case are that on 19.09.2006 at about 1.00 p.m. at The Central Law College, Salem, a section of students unlawfully entered the verandah of the classrooms, shouted slogans against the management, formed an unlawful assembly, threw stones and flowerpots on glass windows, damaged fans, tables, chairs, water coolers and tube lights and wrongfully confined the Principal and staff threatening them with life. 3. A case was registered in Crime No.1342 of 2006 on 19.09.2006 for the alleged offences under Sections 147, 148, 342, 506(ii), 427 of Indian Penal Code, 1860 and Section 3(1) of Prevention of Damage to Public Property (PPDL) Act, 1984. The final report was filed on 28.02.2005 thereafter and the accused have been facing trial since then. Thus, it is seen that the allegations concern the exercise of the democratic right to protest. In view of the context and nature of the allegations, continuing the trial would impinge upon the accused’s right to a speedy trial, and no useful purpose would be served by keeping the case pending. 5. Accordingly, the case in P.R.C.No.1900005 of 2008 of Judicial Magistrate IV, Salem Taluk, Salem shall stand quashed and this Suo Motu Transfer Case stand disposed of. 22.09.2025 nsl Note to the Trial Court: This order is digitally signed and communicated electronically alone.
