Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioners have approached this Court with the grievance that in an around the land of the petitioners, subject matter of this writ petition, a big Bulk Drug Pharma Park stands created, as a result whereof, the cattle of the petitioners have no space for grazing etc. There are 150/milch animals with the petitioners and in this backdrop, the petitioners pray that a direction be issued to the respondent-State to acquire the land of the petitioners and compensate them, so that they can purchase some other land or to rehabilitate them in some other area where the petitioners are in a position to provide fodder to their cattle as well as grazing grounds.

Having heard learned counsel for the petitioners as well as learned Additional Advocate General and having carefully perused the pleadings, this Court is of the considered view that as it is being disputed by the respondents that there is no land available for the grazing etc. of the cattle of the petitioners, obviously, these disputed issues cannot be decided by this Court under Article 226 of the Constitution of India.
4. At this Stage, learned counsel for the petitioners submits that the petitioners be allowed to withdraw this petition, but with liberty to approach learned Civil Court.
5. The petitioners are allowed to withdraw the petition, with liberty as prayed for. The petition stands disposed of. Pending miscellaneous applications, if any, also stand disposed of.
