Heard Mr. R.S. Mishra, learned counsel for the petitioner. Mr. M. Chetia, learned Government Advocate, Assam and Mr. S.S. Roy,
learned counsel for the respondent nos. 4 and 5 are also present.
2. Mr. R.S. Mishra, learned counsel for the petitioner having realized that no appeal has been filed as required under the provisions of Section 233 of Assam Municipal Act, 1956, fairly submits that he may be allowed to withdraw this writ petition with a liberty to file an appeal before the appropriate authority as per the provisions of law.
3. The prayer for withdrawal is allowed.
