Petitioners Versus The State of Jharkhand .... .... .... Opposite Party ------ CORAM : HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioners : Mr. Sourav Kumar, Advocate For the State : Mr. Shree Prakash Jha, Advocate ------ Order No.02 Dated- 07-04-2025 Heard the parties. Apprehending their arrest, the petitioners have moved this Court for grant of privileges of anticipatory bail in connection with Govindpur P.S. Case No. 20 of 2025 registered for the offences punishable under sections 126, 115(2), 109, 303, 351(3) and 3(5) of B.N.S. Act, 2023. Learned counsel for the petitioners submits that petitioner no.1 namely Abhimanyu Kumar @ Sonu has since been arrested, hence, and the petitioners do not press the instant anticipatory bail application in respect of the petitioner no.1 namely Abhimanyu Kumar @ Sonu. Accordingly, this anticipatory bail application stands rejected as not pressed in respect of the petitioner no.1 namely Abhimanyu Kumar @ Sonu. So far as petitioner No.2 namely Abhishek Kumar @ Tuntun is concerned, it is submitted by the learned counsel for the petitioner that the allegation against the petitioner No.2 namely Abhishek Kumar @ Tuntun is that he, being member of an unlawful assembly, in furtherance of common object of the said unlawful assembly, attempted to murder of informant Upendra Kumar. It is submitted that the allegation against the petitioner No.2 namely Abhishek Kumar @ Tuntun is false and general and omnibus in nature and the main allegation is against the petitioner no.1 Abhimanyu Kumar. It is next submitted that no injury report has been submitted by the alleged victim in support of his contention that he sustained injury. It is further submitted that the petitioner No.2 namely Abhishek Kumar @ Tuntun has no criminal antecedent as stated in para- 14 in the anticipatory bail application. It is lastly submitted that the petitioner No.2 namely Abhishek Kumar @ Tuntun undertakes to cooperate with the investigation of the case, to furnish sufficient security including cash security and that he will not annoy or disturb the informant or any of his family members in any manner during pendency of the case. Hence, it is submitted that the petitioner No.2 namely Abhishek Kumar @ Tuntun be given the privileges of anticipatory bail. Learned Addl. P.P. opposes the prayer for grant of anticipatory bail. Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that it is a fit case where the above named petitioner No.2 namely Abhishek Kumar @ Tuntun be given the privilege of anticipatory bail. Hence, in the event of his arrest or surrender within a period of six weeks from the date of this order, he shall be released on bail on depositing cash security of Rs. 10,000/- and on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamshedpur in connection with Govindpur P.S. Case No. 20 of 2025 with the condition that the petitioner will cooperate with the investigation of the case and appear before the Investigating Officer as and when noticed by him and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the pendency of the case and he will not annoy or disturb the informant or any of his family members in any manner during pendency of the case subject to the conditions laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
