Respondent For Petitioner : Mr.S.Sugendran Additional Public Prosecutor ORDER This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2. The allegations in this case are that on 02.04.2008 and again on 03.04.2008 the accused students, after attending viva-voce, came back to the college in a drunken condition, rode motorbikes inside the campus, damaged glass panes and college property and threatened lecturers with an iron rod. They again assembled unlawfully, insisting on a lecturer’s presence and Page No.1 of 3 https://www.mhc.tn.gov.in/judis Suo Motu TR.No. 14748 of 2025 indulged in vandalism of the administrative block and classrooms. 3. A case was registered in Crime No. 189 of 2008 on 05.04.2008 for the alleged offences under Sections 147, 148, 324, 427 and 506(ii) of Indian Penal Code and Section 3 of Prevention of Damage to Public Property Act, 1984, The final report was filed on 21.05.2008 and the accused have been facing trial since then. Thus, it can be seen that the allegations concern a protest turning violent inside the college premises. Given the context and nature of the allegations, continuing the trial impinges on the right to a speedy trial of the accused. No useful purpose will be served by continuing the case. 4. Accordingly, the case in P.R.C.No. 1900031 of 2008 of Judicial Magistrate IV, Salem Taluk, Salem shall stand quashed and this Suo Motu Transfer Case stand disposed of. 22.09.2025 nsl Note to the Trial Court: This order is digitally signed and communicated electronically alone.
