( 2025:JHHC:11627 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI
B.A. No. 3070 of 2025
------ Ramdhan Pradhan, age 47 years, son of late Ramjatan Pradhan @ Dhakna Prdhan, resident of Village-Jamgai Burjudih, P.O. & P.S.-Raidih, Dist.-Gumla
… Petitioner
Versus The State of Jharkhand … Opposite Party
------
CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Mr. Tarun Kr. Mahato, Advocate For the State
: Mr. Anup P. Topno, Addl. P.P. ------
Order No.02 Dated- 17.04.2025
Heard the parties.
The petitioner has moved this Court for grant of privilege of bail in connection with Sessions Trial No. 299 of 2023 arising out of Raidih P.S. Case No.16 of 2023 registered for the offences punishable under sections 302 of the Indian Penal Code.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed the murder of Chamu Pradhan. It is further submitted that the allegations against the petitioner are all false and the petitioner has no idea as to how many witnesses have been examined during the trial so far. It is then submitted that the petitioner has been in custody since 10.05.2023, as has been mentioned in paragraph no. 12 of the bail application. Hence, it is submitted that the petitioner be admitted to bail.
The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that there is direct and specific allegation of committing murder of Chamu Pradhan and in view of overwhelming evidence regarding commission of murder of Chamu Pradhan, there is every chance of the petitioner absconding if released on bail. Hence, it is submitted that the petitioner ought not be admitted to bail.
Considering the serious nature of allegation against the petitioner of committing murder of Chamu Pradhan and the materials in the record as well as the chance of the petitioner absconding if released on bail, this Court is of the considered view that this is not a fit case where the abovenamed petitioner be admitted to bail. Accordingly, the prayer for grant of privilege of bail of the abovenamed petitioner is rejected.
