Order On Board 25/04/2025 The applicant has preferred this first bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as he is arrested in connection with Crime No.250/2022 registered at Police Station – Sarkanda, Distt. Bilaspur (CG) for the
2 offence punishable under Sections 420, 467, 468, 471, 120B, 34 of IPC.

As per the prosecution case, the complainant lodged a written report alleging that the applicant in connivance with other co-accused persons prepared forged and fabricated documents, thereby mutation of the land was done in the revenue records and thereafter a case was registered against the applicant and other co-accused persons under the aforesaid sections.

Learned counsel for the applicant submits that the applicant is an innocent person and has been falsely implicated in the crime in question. The applicant has not committed any cheating or forgery. Neither any forged or fabricated document has been seized from the possession of the applicant nor was the same verified from the experts. He submits that the applicant is languishing in jail since 18.1.2025; charge sheet has already been filed and conclusion of the trial is likely to take some time. He further submits that co-accused Suresh Mishra, Ramkumar Yadav and Bhondudas Manikpuri have been granted bail by this Court on 25.7.2022, 28.7.2022 and 15.12.2023 in MCRC Nos.5333/22, 5633/22 and 8489/23 respectively. This apart, other co- accused Ashok Kumar Jaiswal and Harry Joseph have been granted bail by the Hon’ble Supreme Court on 20.9.2023 and 4.4.2024 in SLP (Crl.) No.8578/23 and 15912-15913/23 respectively. Therefore, the present applicant may also be released on bail.

04. On the other hand, learned counsel for the State opposes the bail application.
05. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, the fact that the applicant is in jail since 18.1.2025; charge sheet has already been filed; the main accused as also other co-accused have been granted bail by this Court and the Hon’ble Supreme Court and that conclusion of the trial is likely to take some time, without commenting anything on merits of the case, I am inclined to release the applicant on bail. Accordingly, the bail application is allowed.

It is directed that the applicant shall be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the trial Court for his appearance before the said Court as and when directed, till final disposal of the trial.
