Mr. Sachin Kumar Sharma, Advocate for the petitioner. Mr. N.S. Pundir, Advocate for the respondents. 2. Petitioner served as Conductor in Uttarakhand Transport Corporation and retired on 31.12.2019. By means of this writ petition, he has sought the following reliefs: “a. Issue a writ, order in the nature of Certiorari for quashing the impugned order dated 27.08.2021 passed by the respondent no. 4 to that extent the recovery has directed (contained as Annexure No. 1 to this writ petition). b. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to pay the arrear of amount i.e. Rs. 39308 along with interest @ 18% per annum from the dated of retirement till date of actual payment. c. Issue a writ order or direction in the nature of mandamus commanding and directing the respondents to re-fix the pay scale of the petitioner as per 2nd and 3rd ACP and to pay the difference of the payment towards the arrear of payment of petitioner.” 3. Learned counsel for the petitioner submits that he is not pressing relief as claimed in prayer No. ‘c’ and he may be permitted to withdraw the said prayer. The prayer, as made, is granted. 4. Learned counsels for the parties are unanimous that issues raised by petitioner in this writ petition have already been considered and decided by Division Bench of this Court vide 2025:UHC:7546 judgment dated 04.04.2024 passed in Special Appeal No. 245 of 2022. 5. Learned counsels have drawn attention of this Court to order dated 03.12.2024, passed in WPSS No. 2276 of 2024, whereby writ petition was disposed of in terms of the judgment rendered by Division Bench in Special Appeal No. 245 of 2022. 6. Having regard to the concession made by learned counsel for Uttarakhand Transport Corporation, present writ petition is also decided in terms of the judgment rendered in Special Appeal No. 245 of 2022.
