1. The petitioner has filed the present writ petition under Article 226 of the Constitution of India with a prayer to issue a writ in the nature of Mandamus directing respondents to extend the benefits of service and salary at par with the employees who were appointed in the same selection i.e. in the pay scale of 10300-34800-3200 G.P along with arrears of salary with interest @ 18% per annumn as amended vide 6th Pay Commission in the Pay Band of Rs.33300 + admissible allowances and also giving notional benefits.. A further prayer has been made to direct the respondents to decide the representation dated 14.07.2025 (Annexure P-12) in a time bound manner.
2. A further prayer has also been made to issue a writ in the nature of Certiorari to quash the letter dated 04.01.2024 &19.01.2024 (Annexure P-5/A).

Learned counsel for the petitioner contends the said benefit has already been granted to several other similarly situated employees as well.
Learned counsel for the petitioner next contends that the case of the petitioner is squarely covered by the ratio of the law laid down by this Court in CWP-15896- HITESH 2025.09.24 16:04 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh
CWP-28386-2025 -2 2023 (O&M), titled as “Saurabh Sharma and others Vs. State of Punjab and Anr.” dated 13.09.2024 which has been upheld by the Division Bench of this Court as well as by the Hon’ble Supreme Court. (Annexures P-8 & P-9).

Learned counsel further submits that the petitioner has already submitted a representation dated 14.07.2025 (Annexure P-12) to respondent No.4 and she shall be satisfied in case, appropriate directions are issued to the respondent No.4 to decide the representation dated 14.07.2025 (Annexure P-12) in a time bound manner.
5. Notice of motion.
6. On the asking of the Court, Mr.Swapan Shorey, DAG, Punjab, who is present in the Court, accepts notice on behalf of the official respondents and has no serious objection to the prayer made by learned counsel for the petitioners, at this stage.
7. I have heard learned counsel for the parties and perused the record carefully.

At this stage, it would be appropriate to direct the respondent No.4 to decide the representation dated 14.07.2025 (Annexure P-12) in view of the law laid down by this Court in CWP-15896-2023, titled as “Saurabh Sharma and others Vs. State of Punjab and Anr.” dated 13.09.2024 which has been upheld by the Division Bench of this Court as well as by the Hon’ble Supreme Court. (Annexures P-8 & P-9) as well as in view of (Annexures P-20 & Annexure P-21) within a period of four months from the date of receipt of certified copy of this order.
9. Needless to observe that the respondent No.4 shall pass a speaking HITESH 2025.09.24 16:04 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh
CWP-28386-2025 -3 and well reasoned order in the light of the above referred judgment as well as in view of (Annexures P-20 & Annexure P-21) and relevant rules/instructions and in case, it is found that the petitioner is entitled to relief claimed in the representation, consequential benefits may also be released to the petitioner without any further delay, thereafter, along with interest.
