Petitioner is aggrieved by the decision taken by respondent no. 4. By the said decision, petitioner was denied relaxation in upper age limit for contesting election to the Students’ Union of L.B.S. Government Degree College, Halduchaur, Nainital. 5. This Court is not inclined to interfere with the decision taken by respondent no. 4, as the University byelaws provide that in no circumstances, a student, who has crossed 25 years of age, can be permitted to contest elections of Students’ Union. 6. Hon’ble Supreme Court in the case of University of Kerala (1) v. Council, Principals’, Colleges, Kerala and others reported in (2006) 8 SCC 304 has also provided that for PG students, the 2025:UHC:7545 maximum age limit to contest Students’ Union Election would be 24-25 years. 7. Since, Hon’ble Supreme Court has provided the upper age limit in the aforesaid judgment, therefore, this Court cannot pass any order, which is in teeth of the order passed by Hon’ble Supreme Court. 8. Thus the writ petition fails and is dismissed. No order as to costs.
