Applicant is in judicial custody in Special Sessions Trial No. 32 of 2023, in FIR No. 06 of 2023, under Sections 376, 504, 506 IPC and Section 3/4 of the Protection of Children From Sexual Offences Act, 2012, Police Station Jhulaghat, District Pithoragarh. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

This is second bail application of the applicant. His first bail application was dismissed as withdrawn on
08.04.2024.

According to the FIR, the applicant has been sexually exploiting the victim for 8-9 months.

Learned counsel for the applicant would submit that the applicant and the victim both were in romantic relationship. This is what the victim has stated during investigation or trial. The FIR has been lodged under the
2 pressure of the family of the victim as her one of the relatives is in Police.

Learned State counsel would submit that the applicant and the victim both were in romantic relationship, but he would submit that by showing the nude photographs of the victim, the applicant established physical relations with her.

Having considered the facts and circumstances of the case, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
