The petitioner who has retired from the post of Accountant from the Department of Transport on 31.07.2018 preferred the present writ petition seeking a direction towards the respondent for grant of promotion to the petitioner for the post of Assistant OfÏce Superintendent with effect from 06.07.2004. During the pendency of the writ petition, the respondent in its reply submitted a communication of Deputy Transport Commissioner, in which they have stated that review DPC has been convened on 23.12.2024 and in which the recommendation of the DPC dated 22.04.2014 has been reiterated and the matter has been sent to the State Government for approval, to grant the benefit of the said recommendation of the DPC held on 22.04.2014. 3 2. Learned counsel for the respondent further submits that in view of the recommendation made on 03.04.2025, the Deputy Secretary shall take a decision within a stipulated period and the benefit of the said recommendation will be given to the petitioner only after government approval. 3. I have heard both the parties and perused the communication dated 23.12.2024 (Annexure R/1) which is a communication of Deputy Transport Commissioner Chhattisgarh Raipur to the Deputy Secretary Transport Department dated 03.04.2025 by which the Deputy Transport Commissioner has requested the State Government for necessary approval for grant of benefit to the petitioner as per the recommendation of the DPC held on 22.04.2014 and review DPC dated 23.12.2024, hence the writ petition is disposed of with a direction to the Deputy Secretary State of Chhattisgarh Department of Transport to take a decision on the recommendation of DPC and as well as the communication sent by the Deputy Transport Commission on 03.04.2025 within a period of 40 days and to give benefit of the recommendation of the DPC dated 22.04.2014 and review DPC dated 23.12.2024. 4.
