HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2555 of 2025 ORDER: 1. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner is the husband of the 2nd respondent. He was arraigned as A.1 in Crime No.29 of 2025 of Mahila Urban Police Station, Guntur, for the alleged offences under Sections 85, 351(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 3. The learned counsel further submits that the 2nd respondent filed a false complaint for the alleged offence. The 2nd respondent also arraigned the parents, sister and brother-in-law of the petitioner as accused. The marriage of the 2nd respondent with the petitioner/A.1 was solemnized on 09.05.2007. On account of certain marital disputes, the petitioner and the 2nd respondent have been staying away for the last five years, and the petitioner/A.1 also filed F.C.O.P. No.230 of 2022 before the II Additional District & Sessions Judge-cum-I Additional Family Court, Medchal, and on account of non-appearance of the 2nd respondent, an ex-parte decree was granted. It is further submitted that the 2nd respondent, after having come to know about the divorce, has filed a false complaint. -2- CRL.P. No.2555 of 2025 4. Considering the submissions of the learned counsel for the petitioners, this Court deems it appropriate to dispose off the criminal petition by directing the Station House Officer, Mahila Urban Police Station, Guntur, to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, for the purpose of investigation in connection with Crime No.29 of 2025, insofar as the petitioner is concerned. 5. Accordingly, the criminal petition is disposed off. 6. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed. ____________________ JUSTICE HARINATH.N BV
