Neutral Citation No. - 2025:AHC:14017-DB Court No. - 29 Case :- WRIT - C No. - 35429 of 2024 Petitioner :- Lalita Devi Respondent :- State Of U.P. And 14 Others Counsel for Petitioner :- Arvind Kumar Srivastava,Bhaju Ram Pprasad Sharma Counsel for Respondent :- C.S.C.,Pradeep Singh Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Heard learned counsel for the parties. According to the petitioner, on her Bhoomdhari over Plot No.95, Village Panchayat is illegally making construction of drainage. Report is also allegedly submitted, as per which construction is over Plot No.95. In the facts of the case, it appears that there are issues of identification and demarcation of the land over Plot No.95 which allegedly is Bhoomdhari of the petitioner. On such land without undertaking acquisition or obtaining consent of the petitioner, no construction of drainage or any public utility services would be permissible. In that view of the matter, we permit the petitioner to ventilate her grievance before respondent no.4 by annexing all materials in support of her claim. Fourth respondent shall ensure that no construction of drainage or public utility services is allowed on Bhoomdhari land of the petitioner without obtaining petitioner's consent or acquisition of land. In the event there is an issue of demarcation, the matter shall be brought to the notice of the SDM who would ensure that appropriate demarcation of the plot is undertaken on the spot. Such action would be taken within a period of four weeks from the date of presentation of a certified copy of this order. If the authorities find that any drainage has been constructed on the petitioner's Bhoomdhari land without her consent, the authorities shall ensure restoration of the land in favour of the recorded tenure holder. Accordingly, the instant writ petition is disposed of. Order Date :- 27.1.2025 rkg Digitally signed by :- RAKESH KUMAR GAUTAM High Court of Judicature at Allahabad
