Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant application under Section 528 BNSS has been filed with a prayer to allow the application and quash the impugned NBW order dated 02.09.2025 in Complaint Case No. 3233 of 2016 (Krishnapal v. Bablu @ Kaliya) under Section 436 IPC pending in the Court of Additional Chief Judicial Magistrate (Junior Division), Court No. 31, Shahjahanpur. Learned counsel for the applicant states that non-bailable warrant has been issued against the applicant. At the very outset, learned counsel for the applicant gives an undertaking that the applicant shall appear before the Court concerned and cooperate in the trial. In view of the above, in case, the applicant appears and participates in the trial proceeding before the Court concerned, Non-Bailable Warrant issued against the applicant, shall remain in abeyance. It is made clear that in case, the applicant does not cooperate and participate in the trial proceeding, he will not be entitled to the benefit of this order. With the above observations, this application under Section 528 BNSS is disposed of.
