Nigam, holding brief of Sri Suresh Singh, learned counsel for the petitioner and Sri Nand Lal Maurya, learned Standing Counsel for the State-respondents. A grievance is sought to be raised with regard to an alleged illegal encroachment over certain Gram Sabha land. It is also averred that the Gram Sabha has instituted a suit, being Suit No. 313 of 2004 (Gaon Sabha vs. Chokat), under Section 229B of the U.P.Z.A. & L.R. Act, 1950, and the same is pending. Having regard to the fact that the Gram Sabha has initiated the proceedings against the aforesaid encroachment, which is stated to be pending, and also for the reason that any grievance with regard to alleged encroachments over Gram Sabha land can be addressed by invoking the appropriate statutory remedy under the U.P. Revenue Code, 2006, this Court is not inclined to entertain the writ petition. The writ petition is accordingly dismissed. The dismissal of the writ petition would not preclude the petitioner from seeking the appropriate statutory legal remedy.
