HIGH COURT OF JUDICATURE AT ALLAHABAD PUBLIC INTEREST LITIGATION (PIL) No. - 3133 of 2025 Chief Justice's Court HON'BLE ARUN BHANSALI, CHIEF JUSTICE HON'BLE KSHITIJ SHAILENDRA, J. 1. This petition, purportedly in public interest, has been filed by the petitioner seeking a direction to the respondents to transfer respondent No. 5 from the present place of posting. 2. Allegations have been made that respondent No. 5 is posted at Gorakhpur for the last over 11 years and as and when the orders of transfer have been passed, same have either been varied and/or cancelled and therefore, the respondents be directed to transfer respondent No. 5, who is staying at Gorakhpur in violation of transfer policy of the State. 3. A perusal of the petition indicates that the petitioner claims himself to be a social worker and is not personally interested in the subject matter of the petition. In support of the contention, petitioner has annexed a marksheet of his second semester of LL.B. The marks obtained by the petitioner are reflective of his merit, wherein he has obtained 30 to 46 marks out of 100 in all the subjects with a CGPA of 3.40. 4. Besides the above, the petitioner has failed to indicate any cause with regard to the purported public interest involved in the petition insofar as the petitioner himself is concerned. Further, the petition is totally silent as to how and from which source the petitioner has obtained all the documents pertaining to respondent No. 5 regarding the transfers/cancellations thereof. 5. The tenor of the petition and the documents annexed therewith are Versus Counsel for Petitioner(s) : Ashish Pandey, Randhir Jain Counsel for Respondent(s) : C.S.C., Ankit Gaur (S.C.) Sonu Kumar .....Petitioner(s) State of Uttar Pradesh and 4 others .....Respondent(s) clearly reflective of the fact that the petitioner, a student in second/third semester of LL.B., cannot and does not have any concern whatsoever with the subject matter of the petition and has essentially acted as a pawn in the hands of someone, who has personal grudge against respondent No. 5, holding the office at Gorakhpur for purportedly long tenure. 6. The use/misuse of the process of filing of PILs by the disgruntled persons through unassuming petitioners, cannot be countenanced. 7. The petition is, therefore, dismissed with a warning to the petitioner to remain cautious in future. October 7, 2025 Mukesh Pal/AKShukla WPIL No. 3133 of 2025 2 (Kshitij Shailendra,J.)
