HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 34744 of 2025 Court No. - 33 HON'BLE ROHIT RANJAN AGARWAL, J. 1. Proceedings for eviction was initiated against the petitioner on the ground that he has encroached upon Gata No.630, which is recorded as manure pit in the revenue records. Order of eviction was passed which was challenged in appeal filed by the petitioner. The appellate authority have found that the encroachment exists on Gata No.630, and the order of eviction was confirmed. 2. Learned counsel for the petitioner submits that though there is no pleading before the revenue authorities that the house of the petitioner exists on different gata and not on Gata No.630 as claimed in the revenue records, the order of eviction has been passed. 3. I have heard respective counsel for the parties and perused the material on record. 4. From perusal of material on record, I find that specific finding has been recorded that the house of petitioner has been constructed over Gata No.630, measuring 470 Sq.M., which is recorded as manure pit. No ground has been taken in appeal to demonstrate the fact that the house stands on some other gatas, and not on Gata No.630. 5. From perusal of memo of appeal as well as the order passed by revenue authorities, no case for interference is made out. 6. Writ petition is misconceived and same stands dismissed.
