Petitioners appear to be fence-sitter as they want to take advantage of a judgment passed by Coordinate Bench of this Court on 01.10.2024 in a bunch of cases being leading case of University College Retd. Teachers Welfare Association and another vs. State of U.P. and others, 2024:AHC-LKO:68215. 3. Learned counsel for petitioners submits that since now gratuity can be granted to teachers also, therefore, claim of petitioners can still be considered. 4. Learned Standing Counsel has opposed above submissions. 5. In view of above and without making any comment, this writ petition is disposed of with an observation that it is up to respondents to consider claim of petitioner and while considering their claim, concerned respondents may take note that petitioners were fence-sitter.
