To issue a writ, order or direction in the nature of mandamus directing to respondents for payment of compensation to the petitioner for his part of land comprising of khasra no. 187 situated in revenue village Deidiha, Tappa Raipur, Pargana Salempur Majhauli, Tehsil Barhaj, District Deoria in pursuance of the award dated 25.03.2023 passed by respondent no. 3." 2. Learned Standing Counsel for the State respondent has placed on record the written instructions. 3. After hearing the parties at some length, we find that the subject land was recorded as PWD Road vide order dated 17.12.2024 in proceedings under Section 38(3) of the U.P. Revenue Code, 2006. On query made by the Court from counsel for the petitioner as to whether the petitioner has challenged the said order, he states that the order is under challenge before appropriate forum. 4. Under such circumstances, we decline to issue any direction for payment of compensation at this stage. In case the challenge succeeds, it shall be open to the petitioner to seek compensation in accordance with law. 5. The petition stands disposed of accordingly.
