3. The applicant – Monu, who is in judicial custody in connection with FIR/Case Crime No. 88 of 2025, under Sections 105 of BNS, registered at P.S.- Patel Nagar, District Dehradun, has sought his release on bail.
4. Heard learned counsel for the parties and perused the records.
5. An FIR was lodged by the brother of the deceased on 26.02.2025. As per the allegations in the FIR, applicant and the deceased had a quarrel in the night of 25.02.2025 and the applicant who was driving a Loader bearing Registration No. UK07CD3276, dragged the deceased from the running loader to a distance of 500 meters, due to which, the deceased sustained head injuries and died.
6. Learned counsel for the applicant would submit that the complainant is not the eye-witness and the only evidence against the applicant is the CCTV footage. Besides this, there is an electronic evidence of a CCTV camera from the nearby shop in which the applicant is not
seen in the picture, but, the deceased is seen hanging with the window of the driver side of the loader; that applicant is in jail since 25.2.2025 and the applicant has no previous criminal history.
7. Learned State Counsel, on the other hand, has vehemently opposed the bail application and would submit that the offence alleged is of a grave and heinous nature.
8. Having considered the submissions, under the facts and circumstances of the case, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.
9. Accordingly, the bail application is allowed.
10. Let the applicant be released on bail on his executing a personal bond and furnishing two reliable sureties each of the like amount, to the satisfaction of the court concerned.
